It was a routine drive back to the Verizon shop on Westchester Ave in the Bronx after a service call when a distracted driver crashed into the side of our clients service truck. At first, he thought he would be fine, but the pain got worse and worse. Eventually, he needed surgery to his neck. The insurance company of the car that hit him refused to offer anything, claiming our client’s neck injury was not from this crash, but from a prior car crash 5 years earlier. After a two week trial a Bronx jury determined the neck surgery was in fact from this car crash and awarded $350,000. The case was tried by Sharon Scanlon.
